Romania: Latest Legislative Amendments on RO e-Transport: GEO 87/2004 and National Agency for Fiscal Administration (ANAF) and Romanian Customs Authority (AVR) Order 1337/1268/2024

Recently, important legislative changes have been adopted in the field of monitoring the transport of goods through the RO e-Transport system, under Government Emergency Ordinance No 87/2004 and ANAF and AVR Order 1337/1268/2024.

Amendments adopted by GEO 87/2004

Government Emergency Ordinance No 87/2004 brings an important exception for economic operators authorised under Article 38 of Regulation (EU) No 952/2013 of the European Parliament and of the Council of 9 October 2013 laying down the Union Customs Code (recast), namely the charging of administrative offences and the application of sanctions for non-compliance with the obligations to declare in the RO e-Transport system, provided for by GEO 41/2022, as from 1 January 2025.

Thus, economic operators that have obtained the status of authorised economic operator will be exempted from the application of sanctions, respectively from the charging of administrative offences provided for by the legislation in force for failure to comply with the obligations to declare in the RO e-Transport system, until 1 January 2025.

Order ANAF and AVR 1337/1268/2024 for the approval of the Procedure for the use and operation of the national system for monitoring the transport of goods RO e-Transport

In addition to the amendments made by GEO 87/2004, on 27 June 2024, the Procedure for the use and operation of the national system for monitoring the transport of goods RO e-Transport, approved by ANAF Order 1337/2024, entered into force. This procedure clarifies the application and operation of the RO e-Transport system.

Among the main changes introduced by the new procedure are:

  • Clarification of the scope and establishment of clear criteria for registration and validation of road transport of goods in the e-Transport system.
  • Introducing mechanisms for reporting street sales on the national territory (“Van Sales”) to ensure compliance of economic operators with the new regulations.
  • Clarifications on the application of sanctions related to reporting obligations in the system.
