Lithuania: bnt Vilnius Partner Frank Heemann and Senior Associate Karolina Gasparkė shared their expertise at a Cross-Border Corporate Insolvency Symposium in London.

bnt Vilnius lawyers Frank Heemann and Karolina Gasparkė shared their knowledge on the topic Treatment of Executory Contracts in Lithuanian insolvency law during the Cross-Border Corporate Insolvency & Commercial Law Research Group Conference and Symposium. The event took place at the City University of London on 6 April 2017 and brought together academics, practicing lawyers and other experts who presented a diverse range of topics in the field of insolvency law.

The topic presented by bnt experts Frank Heemann and Karolina Gasparke relates to the treatment of executory contracts in insolvency and is of immense practical relevance. It addresses the fate of contracts (for example rental, purchase, loan, employment, licence, and service agreements) which have been concluded before and (only) partly performed at the moment when one of the parties faces insolvency. Does the principle of pacta sunt servanda (contractual obligations are to be performed) prevail over the right of insolvency administrators in most countries to decide to a certain degree on the fate of contracts concluded before the opening of insolvency proceedings?
