As of October 10, 2024, Order 539/2024 issued by the National Authority for Consumer Protection (ANPC) came into effect, introducing clear measures regarding consumer information in cases of shrinkflation – where the volume or weight of a prepackaged product decreases, but the price remains the same.
According to the order, economic operators are required to clearly and visibly display information at the point of sale, within the same visual field as the affected product. This notification must remain visible for at least 30 days from the introduction of the product on the shelf. The purpose of this measure is to protect consumers from potential market dysfunctions and ensure accurate and complete information.
Additionally, since there is no established market practice regarding these obligations, it is recommended that if producers or distributors adjust product quantities without changing the sale price to retailers, they should inform the latter to ensure further transparency with consumers.
Distance sales are exempt from this obligation. In a constantly changing market, transparency between producers, retailers, and consumers is essential.
