Lithuania: Psychological work environment What homework must you do?

Article 30 of the LC has changed. Employers’ responsibility for ensuring safe psychological working environment tightened up.

The amendment and addition to Article 30 of the Labour Code (LC), which entered into force on 1 January 2025, creates additional obligations for employers to ensure a safe psychological working environment. The article specifies that all violence and harassment by employers is prohibited.

As part of the implementation of the Article amendment, the Chief State Labour Inspector of the Republic of Lithuania has issued a description of measures to prevent violence and harassment at work. This description establishes a list of mandatory preventive measures to reduce the risk and consequences of violence and harassment at work for workers and the procedure for their implementation, as well as the frequency of training on the risks of violence and harassment, preventive measures, and the rights and obligations of workers in relation to violence and harassment. The employer must provide such training at least once every 3 calendar years.

Importantly, an amendment to the Code of Administrative Offences has also entered into force. From now on, an employer will be fined between €500 and €1,400 if the necessary measures to prevent violence and harassment have not been implemented, or if active steps have not been taken to provide assistance to persons who have suffered violence and harassment.

We therefore invite all employers, regardless of their company size or the nature of their activities, to check whether they have implemented all the necessary measures to prevent violence and harassment.

Reminder:

What a company must do if they only have a few employees:

  • Adopt procedures for reporting and handling reports of violence and harassment;
  • Provide training for employees on the prevention of violence and harassment;
  • Carry out an occupational risk assessment, which must, among other things, assess the risks posed by psychosocial risk factors.

What a company with more than 50 employees must do:

  • Adopt a Workplace Violence and Harassment Policy, which regulates the procedures for reporting and handling reports of violence and harassment;
  • Provide training for staff on the prevention of violence and harassment;
  • Carry out an occupational risk assessment, which must, among other things, assess the risks posed by psychosocial factors.
